In compliance with Ohio Revised Code 4585.31, Battery Park
Marine Services is overseeing the auction of approximately 13 abandoned
boats and motors left in storage on its property.
Dates of
previewing the boats and motors will be Saturday, June 16, from 9:00am –
noon and Saturday, June 23, from 10:30 am until the start of the auction.
Boarding of boats will be allowed ONLY during the preview times and all
persons boarding a boat(s) must sign a waiver holding Battery Park Marine
Services harmless in case of any injuries or accidents. Boarding will not
be permitted on some boats.

Auction will take place at Battery Park Marine Services, 1231 First
Street, Sandusky, OH, 44870. Phone 419-625-1666.
All
information provided is deemed reliable but not guaranteed. Independent
appraisals were made by John Brown, Yacht Brokers of Sandusky, on May 23,
2007. Appraisals have taken into account book value less current
condition of boat or motor. Value to purchaser may be higher or lower
than appraised value depending upon intended use. Battery Park Marine
Services, Gregory A. Belhorn, Auctioneer, and John Brown, Yacht Brokers of
Sandusky make no guarantee, express or implied, regarding the condition,
value and seaworthiness of these boats and motors. The boats and motors
listed are subject to change.

Terms and Conditions of the Auction:
1) All bidders are responsible for reading and understanding these Terms and
Conditions, as well as any supplemental notices provided either in writing
or verbally prior to the start of the auction.
2) All boats or motors sold, "as is, where is" and must be paid for by cash,
MasterCard, Visa, Discover or American Express, by 4:00 p.m. on the day of
the auction.
3) For each item sold, an administrative fee of $25.00 is due per boat and
per motor to Battery Park Marine Services.
4) As a buyer of a boat or motor under ORC 4585.31, a copy of ORC 4585.32
"Auction sale purchaser's certificate of title" will be provided to you.
This copy describes the information presented to you and instructs you how
to obtain the certificate of title.
5) For the boats and motors that are being auctioned under ORC 4585.31, a
package will be given to you, the buyer, upon receipt of your payment, with
all the documents and affidavits required under the revised code.
6) A few of the boats being auctioned will have a clear "Title" or "Bill of
Sale", which will be assigned to the purchaser.
Some notes for individuals participating in
the auction:
1) Under the ORC 4585.31, for boats which have outboard motors, the outboard
motor must be auctioned separately. If a different bidder is the winning
bidder for an outboard motor than the bidder who was the winning bidder on
the boat, the staff at Battery Park Marine Services will be available
immediately to remove the outboard from the boat at no charge. Only the
outboard motor will be removed; all controls for the motor will remain as
part of the boat.
2) All boats and motors must be removed from the premises no later than
Saturday, June 23, 2007.
3) For those who will require assistance for loading a boat on a trailer,
launch boat or have the mast unstepped/stepped, or any other type of work, a
work order will be required from Battery Park Marine Services and paid
before the boat is moved from the property.
4) Boats sold are to be taken off the property as a unit and not stripped
for parts/engines on the property.
5) Due to the unique nature of this auction, the owner of the property,
Battery Park Marine Services, is allowed to bid on the boats or motors if it
desires.
